rshc's archive is a user-contributed personal archive. Contributors are responsible for having the rights and permissions needed for their submissions. The operator will review credible complaints and take action that is appropriate for the material, the evidence, the Site, and applicable law.
1. Where to send a report
Send a written report through the feedback form or by email to rshcsoundcloud@gmail.com. Include the page or file URL and enough detail for the operator to understand and locate the material.
The feedback form is the primary contact route shown by this Site. Unless the operator separately publishes and registers a designated copyright agent, this page by itself is not a representation that a statutory agent has been registered or that the operator qualifies for any particular safe harbor.
2. Copyright notice requirements
If you are the copyright owner or are authorized to act for the owner, a notice intended to request removal should include:
- your physical or electronic signature;
- identification of the copyrighted work that you believe has been infringed, including a representative list if one notice covers multiple works;
- identification of the material that you want removed, together with the exact URL or other information reasonably sufficient to locate it;
- your name and reliable contact information, such as an email address and postal address;
- a statement that you have a good-faith belief that the complained-of use is not authorized by the copyright owner, the owner's agent, or the law; and
- a statement that the information in the notice is accurate and, where required, that you are authorized to act for the copyright owner under penalty of perjury.
A report should identify the copyrighted work, not merely state that you dislike or disagree with the material. If the complaint concerns a collection, post, or file, list each relevant URL or provide a clear representative list and a way to locate every reported copy.
3. Review of a notice
The operator may acknowledge a report, request clarification or evidence, contact the contributor, restrict access while reviewing the issue, remove or disable access to material, or leave material available when the report is incomplete, mistaken, disputed, or does not establish a violation.
The operator will respond as promptly as reasonably possible, but this personal archive does not promise a fixed response time. The operator may preserve the notice, the material, relevant account information, and related correspondence for security, dispute resolution, legal compliance, or the defense of rights.
4. Counter-notices
If your material was removed or restricted because of a copyright complaint and you believe that happened because of a mistake or misidentification, you may reply through the same contact route. Explain why the action was mistaken and identify the material and its former location.
If you are asking for a counter-notice under a statutory process, include the information required by the law that applies to that process. This may include your physical or electronic signature, your name and contact information, a statement under penalty of perjury that you have a good-faith belief that the removal resulted from mistake or misidentification, a statement that you consent to the jurisdiction required by the applicable process, and an agreement to accept service of process where required.
A counter-notice may be shared with the complaining party or another recipient when required or permitted by law. Do not include unnecessary sensitive information.
5. False or abusive reports
Do not knowingly submit a materially false claim, misrepresent your authority, or use a copyright process to harass someone, suppress lawful speech, obtain private information, or gain an unrelated advantage. The operator may decline to act on abusive reports and may restrict accounts that repeatedly submit false or fraudulent complaints. Applicable law may impose liability for knowing material misrepresentations.
6. Privacy, publicity, and other rights
A person shown in a photograph or video is not necessarily the copyright owner. If your concern is privacy, impersonation, a right of publicity, non-consensual intimate imagery, personal safety, malware, harassment, or another non-copyright issue, say so clearly and provide the relevant URL, explanation, and requested action. The operator may use a different review process for those concerns.
7. Contributors and repeat complaints
Contributors must not upload material unless they have the necessary rights or permission. A contributor may be asked to provide evidence of authorization, explain the source of a file, or respond to a complaint. Repeated credible complaints, refusal to address rights issues, or other violations may result in content restrictions, account suspension, or account termination.
8. Preservation and confidentiality
The operator will handle reports for the purpose of review, moderation, security, and legal compliance. The operator cannot promise that a report will remain confidential. A report or parts of it may be shared with the contributor, service providers, professional advisers, public authorities, courts, or other parties when reasonably necessary or legally required.
9. No legal advice
This policy describes the Site's reporting route and does not provide legal advice. If you need to protect or enforce a right, consult a qualified lawyer or the relevant rights authority in your jurisdiction. The requirements for a valid notice, counter-notice, court action, or safe-harbor process vary by location and circumstance.
