These Terms of Service are an agreement between you and rshc, the operator of rshc's archive. In these Terms, rshc's archive is called the "Site". By accessing or using the Site, creating an account, or submitting material, you agree to these Terms. If you do not agree with them, do not use the Site or submit material.
These Terms are written for a personal archive and publishing service. They do not replace legal advice, and some provisions may be limited by mandatory law in your location.
1. The Site and its purpose
The Site is a personal, user-contributed archive for collecting, describing, displaying, discussing, and sharing material. It may contain posts, collections, profiles, comments, reviews, links, embedded media, uploaded files, automatically generated covers, and alternate file formats.
The Site is operated by rshc. The operator may change, suspend, restrict, or discontinue any feature, storage location, link, format, or part of the Site at any time.
2. Eligibility
You may use the Site only if you are legally capable of agreeing to these Terms. If you are not legally an adult where you live, use the Site only with the permission and supervision of a parent or legal guardian, and only where that use is permitted by applicable law.
You may not use the Site if doing so would violate a law, court order, sanction, restriction, or other rule that applies to you.
3. Accounts and account security
Some features require an account. You must provide a username and other information that is accurate enough to operate the account. Do not impersonate another person, organization, or account holder, and do not choose a username that is intended to deceive or harass someone else.
Keep your password and other login information confidential. You are responsible for activity carried out through your account unless it occurred because of the operator's failure to take reasonable security measures. Notify the operator promptly if you believe that your account or credentials have been compromised. Do not share an account in a way that bypasses access controls or makes responsibility unclear.
4. Material you submit
You retain ownership of the material you submit, subject to the rights of other people and organizations that may be involved in that material. You are responsible for making sure that you have the rights, permissions, licenses, and authority needed to upload, publish, display, stream, transform, and share it in the way you select.
This responsibility includes titles, descriptions, tags, metadata, profile information, comments, reviews, links, artwork, audio, video, text, software, archives, and any other file or information you provide. Do not submit confidential information, passwords, financial information, or personal information that you do not want to make public.
5. Permission to operate the archive
To operate the Site, you grant the operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, back up, index, display, make available, stream, deliver, and technically process the material you submit. This license also covers creating thumbnails, covers, previews, metadata views, search indexes, feeds, downloads, and alternate formats that are offered by the Site.
The license is limited to operating, securing, maintaining, improving, and documenting the Site. It does not transfer ownership of your material to the operator and does not give the operator a general right to sell your material or use it for unrelated advertising. The license ends when the material is removed, except to the extent that copies must remain temporarily in backups, caches, logs, moderation records, security records, or legal records.
You also grant the operator permission to display your username, display name, profile image, attribution, and other associated information alongside your contributions when needed to identify or present them.
6. Visibility and public material
Material marked public, including public profiles, posts, collections, comments, reviews, and metadata, may be viewed, copied, indexed, cached, downloaded, or redistributed by other people and third-party services. The operator cannot control what others do with material after it has been made public.
Unlisted or link-accessible material is not a promise of confidentiality. Anyone who obtains its link may be able to view or share it. Private or restricted material is intended to have limited visibility, but the operator and infrastructure providers may access it when reasonably necessary to provide the Site, investigate abuse, respond to rights complaints, maintain security, or comply with law.
7. Files, derivatives, and technical processing
The Site may preserve an original upload and create additional versions for playback, preview, compatibility, downloading, or archival access. These versions may include converted audio, video, image, text, or archive formats, as well as generated covers and thumbnails.
Automatic processing can fail, alter metadata, reduce quality, omit unsupported features, or produce a file that is not suitable for a particular purpose. The original file, when available, is the authoritative upload. The operator does not guarantee that every format will be created, remain available, or reproduce every feature of the original.
8. Acceptable use
You must use the Site lawfully and responsibly. You must not:
- infringe copyright, trademark, privacy, publicity, moral, contractual, or other rights;
- upload or distribute malware, ransomware, destructive code, or material intended to damage, overload, or compromise the Site or another person's device;
- upload or distribute child sexual abuse material, sexual exploitation material, non-consensual intimate imagery, credible threats, or material that facilitates violence or serious wrongdoing;
- harass, stalk, threaten, exploit, doxx, defame, impersonate, or expose another person to unreasonable harm;
- use the Site for fraud, phishing, spam, unauthorized advertising, or unlawful solicitation;
- probe, scan, attack, bypass, disable, or interfere with authentication, rate limits, access controls, security features, or another visitor's use of the Site;
- use automated requests, scraping, downloading, or indexing in a way that creates an unreasonable load or evades published limits, except for ordinary use of published feeds and interfaces;
- submit false, abusive, or knowingly misleading reports or counter-notices;
- circumvent a suspension, deletion, moderation decision, or other restriction by creating another account or using another person's account; or
- attempt to use the Site to conceal or facilitate conduct that is illegal where the conduct occurs.
9. Moderation and reports
The Site may provide tools for comments, reviews, favorites, reports, feedback, and moderation. User submissions are not automatically endorsed, verified, or adopted by the operator. The operator may review, hide, restrict, edit, label, move, disable access to, or remove material when reasonably necessary for safety, rights protection, moderation, storage management, reliability, or legal compliance.
The operator may suspend or close an account, limit its access, cancel an upload, or preserve relevant records while investigating abuse, security incidents, rights complaints, or other disputes. The operator may take action without advance notice when immediate action is reasonably necessary. Where appropriate and legally permitted, the operator may provide a general explanation, but is not required to disclose confidential moderation or security details.
10. Copyright and other rights complaints
If you believe that material on the Site infringes copyright or violates privacy, publicity, trademark, or another right, use the Copyright and Takedown Policy and send enough information for the operator to locate and evaluate the material. Do not use a rights report to make threats, obtain unrelated personal information, or suppress lawful criticism or material that you do not own.
11. Third-party content and services
The Site may link to or embed content from services operated by other parties. Those parties control their own content, software, terms, privacy practices, availability, and security. When you open an external link or use an embedded player, your browser may send information directly to that provider. The operator does not control or endorse every external destination and is not responsible for its conduct or availability.
12. Availability and preservation
The Site is not a guaranteed preservation service, backup service, or disaster-recovery service. Files, accounts, posts, links, derivatives, and backups may be unavailable, corrupted, delayed, altered, deleted, or lost. Keep your own copies of anything important.
The operator may migrate storage, change providers, reorganize paths, remove orphaned files, expire incomplete uploads, or modify the data model. These changes may affect URLs, metadata, file formats, and availability.
13. Disclaimers
To the maximum extent permitted by applicable law, the Site and its content are provided on an "as is" and "as available" basis. The operator does not promise that the Site will be uninterrupted, error-free, secure, complete, accurate, current, compatible with every device or format, or suitable for a particular purpose.
The operator does not guarantee the legality, accuracy, safety, ownership, availability, or quality of user submissions, third-party links, embedded media, generated files, or metadata. You use the Site and rely on its material at your own discretion and risk.
14. Limitation of liability
To the maximum extent permitted by applicable law, rshc and the people or providers assisting with the Site will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, revenue, profits, goodwill, access, privacy, or business opportunity arising from or related to the Site, user submissions, third-party services, or these Terms.
Nothing in these Terms excludes or limits liability, rights, or remedies that cannot legally be excluded or limited in your location.
15. Your responsibility for claims
To the extent permitted by law, you agree to reimburse the operator for reasonable losses, claims, costs, and expenses resulting from your material, your account, your misuse of the Site, your violation of these Terms, or your violation of another person's rights. This section does not require you to reimburse the operator for losses caused by the operator's own unlawful conduct or negligence where such a limitation would be prohibited.
16. Governing law and disputes
These Terms are governed by the laws of CZ, without regard to conflict-of-law rules, except where mandatory law provides otherwise.
Unless mandatory law provides otherwise, disputes should be brought before a court or other lawful forum with jurisdiction over the parties and the dispute.
17. General terms
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms, together with the Privacy Notice and Copyright and Takedown Policy, describe the current agreement for using the Site.
The operator may assign or transfer the Site and these Terms as part of a reorganization, sale, or transfer of the service, provided that doing so does not remove rights that cannot legally be removed. You may not transfer your account or obligations in a way that bypasses these Terms.
18. Changes to these Terms
The operator may update these Terms when the Site, its risks, or applicable requirements change. The current version is published on this page, and the last-updated date may be shown above. If you continue to use the Site after an update, you accept the updated Terms to the extent permitted by applicable law. If you do not accept an update, stop using the Site and remove any material that you are entitled to remove.
